Application to Pay Filing Fee in Installments

Only an individual debtor may request permission to pay the filing fee in installments. When the debtor files the voluntary petition, the debtor must file Official Form 103 Application for Individuals to Pay the Filing Fee in Installments ("Application").

When an attorney represents the debtor, the attorney must file a statement disclosing any fees the attorney received from the debtor using the local form MSSB-LR-1006-1 Disclosure of Pre-Petition Fees Paid by Debtor to Debtor's Counsel . Click here for more information.

  1. The Voluntary Petition must indicate that the debtor intends to pay the filing fee in installments. (See Part 2 #8 on page 3.)
  2. The application may request to pay the filing fee in up to four installments, with the last payment due no later than 120 days from the date the debtor files the petition.
